Terms of service

These terms are the agreement between you and Social Capital (“we”, “us”) for your use of the Social Capital app and this website (together, “the service”). By creating an account or using the service, you agree to them. Please also read our privacy policy, which explains how we handle your data.

1. Who can use Social Capital

You must be at least 16 and able to enter into a binding agreement. If you use the service for an organisation, you confirm you’re allowed to accept these terms for it.

2. Your account

Keep your sign-in details secure. You’re responsible for what happens under your account. If you think someone else has access to it, tell us straight away at support@getsocialcapital.com.

3. What you capture is yours

You keep ownership of everything you add: notes, voice memos and what you record about people. You give us permission to store, process and display it only so we can provide the service to you, including through the service providers described in the privacy policy. We don’t claim ownership of it and we don’t use it for advertising.

4. Recording information about other people

You’re responsible for what you record about other people. Only record what you have a fair reason to keep, keep it respectful and accurate, and follow the privacy laws that apply to you. Don’t use Social Capital to harass anyone, to monitor people covertly, or to make decisions about people on discriminatory grounds.

Transcripts, promises and other results produced automatically can be wrong or incomplete. Check anything important before you rely on it. Decisions you make using the service are your own.

7. Price

Social Capital is currently free. If we introduce paid features, we’ll tell you the price and terms first, and you won’t be charged unless you choose to pay. Any in-app purchases would be handled by Apple or Google under their terms.

8. Changes to the service

We’re a small team and the product is improving quickly, so features will change. We’ll give you reasonable notice before we remove something important or close the service, and a way to get a copy of your data.

9. Ending your account

You can stop using Social Capital and delete your account at any time. We may suspend or close an account that seriously or repeatedly breaks these terms. Where it’s reasonable, we’ll warn you first.

10. Our responsibility to you

We provide the service with reasonable care and skill, but we can’t promise it will always be available or free of errors. Nothing in these terms limits liability that can’t legally be limited, such as for death or personal injury caused by negligence, or for fraud, and nothing affects your legal rights as a consumer. Otherwise, as far as the law allows, we aren’t responsible for losses that weren’t foreseeable, or for business losses such as lost profits or opportunities.

11. Apple and Google

These terms are between you and us, not Apple or Google. If you downloaded the app from Apple’s App Store, Apple has no obligation to provide support for it, and Apple and its subsidiaries may enforce these terms as third-party beneficiaries. Your use of the app stores is also governed by their own terms.

12. Changes to these terms

If we make a significant change, we’ll tell you in the app or by email before it takes effect. If you keep using the service afterwards, the updated terms apply.

13. Law

These terms are governed by the laws of England and Wales. If you live elsewhere as a consumer, you keep the protection of the mandatory laws of the country where you live, and you can bring a claim in your local courts.
